This paper examines the link between political liberties and social equality, and contends that the former are constitutive of, i.e. necessary to secure, the latter. Although this constitutive link is often assumed in the literature on political liberties, the reasons why it holds true remain largely unexplored. Three such reasons are examined here. First, political liberties are constitutive of social equality because they bestow political power on their holders, leaving disenfranchised individuals excluded from decisions that are particularly pervasive, coercively enforced, (...) hard to avoid, monopolistic, and final. Second, they are constitutive of social equality due to their positional value, such that those who are denied such liberties are socially downgraded because and to the extent that others enjoy them. Third, they are constitutive of social equality due to their expressive value, in the sense that, by disenfranchising some individuals, the state publicly fails to recognize their equal moral agency. While unpacking these reasons, we address some criticisms of this constitutive link recently raised by Steven Wall and Jason Brennan. (shrink)

En estas páginas se reúnen tres trabajos elaborados en diferentes fechas, pero estrechamente interrelacionados bajo la intención global de aportar algunos elementos a la evaluación de las opciones metodológicas y epistemológicas en el campo de la investigación en Ciencias Sociales. Esos tres escritos nacen de la preocupación por los riesgos a que se ven expuestos los procesos de producción de conocimientos en el área social, sobre todo si consideramos que, dadas ciertas circunstancias del debate epistemológico actual, casi a diario aparecen (...) ofertas bajo la con?signa del nuevo paradigma o del paradigma emergente. Ante estas ofertas suele ocurrir que unos se muestran entusiasmados y otros incrédulos, pero muy pocos, relativamente, se dedican a evaluarlas. Así, sin evaluar las distintas opciones, la investigación social podría llegar a extremos de li?bertinaje académico, inoperancia y descrédito, incumpliendo de ese modo con el delicado compromiso que tienen los investigadores -tesistas, tuto?res y profesores- con respecto a las necesidades de la sociedad actual. En general, el supuesto inicial más importante aquí es que no pode?mos asumir ciegamente una determinada oferta metodológica y epistemo?lógica, por atractiva que parezca, si previamente no la sometemos a una crítica dura, desinteresada y honesta. Bajo esos términos, tomando en cuenta el predominio y la creciente influencia que han llegado a ejercer las propuestas del «paradigma emergente» sobre noveles investigadores sin que éstos dispongan de un cuerpo amplio de contrargumentaciones y señalamientos divergentes, los trabajos aquí presentados se orientan a deslindar aspectos que parecen significativos para una crítica severa y puntual. Esto es aun más urgente si consideramos que, apartando el caso de muchos investigadores respetables y serios que trabajan bajo la óptica del paradigma emergente, recientemente han pululado las posiciones anárqui?cas y descabelladas que también se declaran bajo esa misma óptica. Y, según parece, es aquí donde late un importante peligro para la investiga?ción social. Esperamos que de los trabajos aquí recogidos puedan también deducirse esas diferencias. (shrink)

It presents the basics of the “Relativistic theory of gravitation”, with the inclusion of original texts, from various papers, published between 1987 and 2009, by theirs authors: S. S Gershtein, A. A. Logunov, Yu. M. Loskutov and M. A. Mestvirishvili, additionally, together with the introductions, summaries and conclusions of the author of this paper. The “Relativistic theory of gravitation” is a gauge theory, compatible with the theories of quantum physics of the electromagnetic, weak and strong forces, which defines gravity as (...) the fourth force existing in nature, as a static field equipped with the transmitter particles of the virtual gravitons of spins 2 and 0, within the spirit of Galilei's principle of relativity, in his generalization of Poincaré's Special Relativity that allowed the authors to universalize that the physical laws of nature are complied with regardless of the frames of reference where they apply, integrated into the Grossmann-Einstein Entwurf theory, in its further development, by those authors, therefore, this theory preserves the conservation laws of energy-impulse and angular impulse of the gravitational field jointly to the other material fields existing in nature, in the Riemann's effective spacetime, through its identity with Minkowski's pseudo Euclidean spacetime. Who is a child’s father? Is it the man who raised her, or the one whose genes she carries—or both? We look at the view that men who have raised children they falsely believed to be ‘their own’ have been victims of a form of fraud or are ‘false fathers’. We consider the question of who has been harmed in such cases, and in what the harm consists. We use conceptual analysis, a philosophical method of investigating the use of a (...) concept and the logical implications of its various interpretations. We devise and discuss a number of possible scenarios in which a couple (arguably) become the parents of a child. We use these scenarios to illustrate the tenuousness of the claim that we can simply rely on biology to clarify parent-child relationships. We also discuss some of the underpinnings and implications of the language in which the debate on ‘paternity fraud’ has been framed: ‘duped’ or ‘false’ fathers and ‘cuckoo children’. (shrink)

Vicarious responsibility is a notoriously puzzling notion in normative reasoning. In this article we will explore two fundamental issues, which we will call the “explication problem” and the “justification problem”. The former issue concerns how vicarious responsibility can plausibly be defined in terms of other normative concepts. The latter issue concerns how ascriptions of vicarious responsibility can be justified. We will address these two problems by combining ideas taken from legal theory and moral philosophy. Our analysis will emphasise the importance (...) of the voluntary involvement of the normative parties considered liable in a relation with other normative parties who causally contributed to a prohibited state-of-affairs. The paper examines two possible analyses of fictional names within Pavel Tichý’s Transparent Intensional Logic. The first of them is the analysis actually proposed by Tichý in his (1988) book The Foundations of Frege’s Logic. He analysed fictional names in terms of free variables. I will introduce, explain, and assess this analysis. Subsequently, I will explain Tichý’s notion of individual role (office, thing-to-be). On the basis of this notion, I will outline and defend the second analysis of fictional names. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

Even though co‐parenthood is one of the most significant close personal relationships that people can have, there is relatively little philosophical work on the moral duties that co‐parents owe each other. This may be due to the increasingly questionable assumption, still common in our societies, that co‐parenthood arises naturally from marriage or romantic coupledom and thus that commitment to a co‐parent evolves from a commitment to a marital or romantic partner. In this article, we argue that co‐parenthood should be seen (...) as a relationship in its own right, which generates specific moral duties. Co‐parents should come to explicit agreements with each other regarding the most important areas of potential conflict between them. Such agreements may have to be renegotiated over time. We explore some possible non‐negotiable co‐parental duties such as the duties not to alienate the child from the other parent(s) and not to trap a co‐parent in a particularly vulnerable situation. We consider some legal and societal implications of our argument and, finally, suggest some pragmatic benefits of our proposal. (shrink)

In the standard model of cosmology, λCDM, were introduced to explain the anomalies of the orbital velocities of galaxies in clusters highest according estimated by General Relativity the dark matter and the accelerated expansion of the universe the dark energy. The model λCDM is based in the equations of the General Relativity that of the total mass-energy of the universe assigns 4.9% to matter (including only baryonic matter), 26.8%, to dark matter and 68.3% to dark energy adjusted according observed in (...) Planck mission, therefore, excluding bosonic matter (quantum vacuum). However, the composition of dark matter and dark energy are unknown. Due to that it lacks of a correct physical theory of gravity since General Relativity is only their powerful equations, which in their applications, their results are interpreted arbitrarily. Properties as curvature, viscous fluid, dragging frame and gravity action are attributed mistakenly to the spacetime by the materialist substantivalism, the most credible philosophical interpretation that complements the General Relativity, caused by its absence of physical definition of spacetime and static gravitational field as immaterial, but which violates, the conception of gravity as an effect of coordinates of the generalization of the inertial motion to the accelerated motion and, in particular, the description of the metric tensor of gravity as a geometric field. These properties are really of the quantum vacuum, the main existence form of the matter. In this paper we propose that the quantum vacuum is the source of dark matter and dark energy, therefore, the components of the quantum vacuum are of them. Both are opposite effects of the quantum vacuum that when gravitationally interacts with the cosmic structures, the vacuum it curves and when such interaction tends to cease by declination of the formation of these structures, occurring since near five milliard of years ago, vacuum it maintains quasi plane, since it interacts gravitationally very weakly with itself, accelerating expansion of the universe. This article aims to present that moral particularism is a viable alternative to the dominant ethics of modernity to the present (i.e., Kantian and utilitarian ethics); theories that have been criticized during the last decades, especially, by the requirement of moral impartiality. The agent in these ethics deliberates impartially due to the universalism of moral principles. I will suggest that moral particularism, insofar as it excludes impartiality as a relevant factor in the agents' deliberations, presents reasons to be a plausible (...) ethics. (shrink)

Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. Internationally, there is considerable inconsistency in the recognition and regulation of children's genetic connections outside the family. In the context of gamete and embryo donation, challenges for regulation seem endless. In this paper, I review some of the paths that have been taken to manage children' being closely genetically related to people outside their families. I do so against the background of recognising the importance of children's interests as moral status holders. I look at recent qualitative research involving donor-conceived people (...) and borrow their own words to make sense of a purported interest to know (of) their close genetic ties. I also review ways in which gamete donation may have facilitated new kinds of kinship, which are at the same time genetic and chosen. In short, in this paper, I explore what meaning there could be in genetic connections that is not about parenthood. Further, I argue that the focus on parenthood in previous work in this area may be detrimental to appreciating some of the goods that can be derived from close genetic connections. (shrink)

Voi ilustra schimbările sociale şi legislative în ce priveşte acceptarea statutului moral al copiilor şi a egalității morale între copii şi adulți, folosind exemple din România şi Suedia. Voi examina dinamica dintre aspirațiile legale şi morale la care aderă România în ce priveşte statutul moral al copiilor şi normele sociale despre copii, copilărie, şi familie, care nu sunt întotdeauna în acord cu aceste aspirații. In this article, I deal with Searle’s philosophy of society, the last step to complete his philosophical system. This step, however, requires an examination of the context and presuppositions, or default positions, that make possible the key concepts of this new branch of philosophy. In the first section, I address what the enlightenment vision implies. The second section focuses upon how consciousness and intentionality are biological tools that help us create and maintain the social world. In the third section, I (...) explain the importance of the difference between subjectivity and objectivity. Finally, in the fourth section I elaborate upon the default positions: the existence of one world, truth as correspondence to facts, direct perception, meaning, and causation. Importantly, I show how the context and presuppositions of the philosophy of society are an opportunity of interdisciplinary work between philosophy and the social sciences. (shrink)

Recent decades have seen the facilitation of unconventional or even extraordinary reproductive endeavours. Sperm has been harvested from dying or deceased men at the request of their wives; reproductive tissue has been surgically removed from children at the request of their parents; deceased adults’ frozen embryos have been claimed by their parents, in order to create grandchildren; wombs have been transplanted from mothers to their daughters. What is needed for requests to be honoured by healthcare staff is that they align (...) with widely shared expectations about what people’s reproductive potential ought to be, what marital relationships ought to result in, and which kinds of ties are desirable between parents and children. Costly and invasive technologies are not considered excessive when they are used to support the building of appropriate families. However, deviations from dominant reproductive norms, even if technologically simple and convenient to the participants, are unlikely to receive support. In this paper, we offer examples of such deviations and explore their implications. If reproduction is important as a way of creating genetic relationships, should reproductive material in storage be offered to genetic relatives other than the people from whom it originated? And if parents are allowed to have reproductive material collected from their offspring, or even to use it to create babies, should offspring likewise be allowed to use their parents’ reproductive material? We tackle these questions and suggest ways in which interests in genetic ties could be operationalised in a more coherent and less-invasive manner than they currently are. (shrink)

Esta es una teoría gauge, compatible con las teorías de la física cuántica de las fuerzas electromagnética, débil y fuerte, que define la gravedad como la cuarta (...) fuerza existente en la naturaleza, como campo estático dotada de la partícula transmisora del gravitón virtual de espines 2 y 0, dentro del espíritu del principio de relatividad de Galilei, en su generalización de la relatividad especial de Poincaré que le permitió a los autores la universalización de que las leyes físicas de la naturaleza se cumplen con independencia de los marcos de referencia donde se apliquen. In this brief text we look at one instance of how gender norms continue to inform institutional treatment of parents regarding care for children: specifically, at how the exercise of fathers’ responsibilities for their children can be discouraged or altogether blocked.

Our goal in this paper is to articulate a precise concept of at least a certain kind of disease-mongering, showing how pharmaceutical marketing can commercially exploit certain diseases when their best definition is given through the success of a treatment in a clinical trial. We distinguish two types of disease-mongering according to the way they exploit the definition of the trial population for marketing purposes. We argue that behind these two forms of disease-mongering there are two well-known problems in the (...) statistical methodology of clinical trials (the reference class problem and the distinction between statistical and clinical significance). It is quite plausible to say that you may read or write implies that you may read and you may write (though possibly not both at once). This so-called free choice principle is well-known in deontic logic. Sadly, despite being so intuitive and seemingly innocent, this principle causes a lot of worries. The paper briefly but critically examines leading accounts of free choice permission present in the literature. Subsequently, the paper suggests to accept the free choice principle, but only as (...) a default (or defeasible) rule, issuing to it a ticket-of-leave, granting it some freedom, until it commits an undesired inference. One main goal of argumentation theory is to evaluate arguments and to determine whether they should be accepted or rejected. When there is no clear answer, a third option, being undecided, has to be taken into account. Indecision is often not considered explicitly, but rather taken to be a collection of all unclear or troubling cases. However, current philosophy makes a strong point for taking indecision itself to be a proper object of consideration. This paper aims at revealing parallels between (...) the findings concerning indecision in philosophy and the treatment of indecision in argumentation theory. By investigating what philosophical forms and norms of indecision are involved in argumentation theory, we can improve our understanding of the different uncertain evidential situations in argumentation theory. General Relativity defines gravity like the metric of a Lorentzian manifold. Einstein formulated spacetime as quality structural of gravity, i.e, circular definition between gravity and spacetime, also Einstein denoted "Space and time are modes by which we think, not conditions under which we live" and “We denote everything but the gravitational field as matter”, therefore, spacetime is nothing and gravity in first approximation an effect of coordinates, and definitely a geometric effect. The mathematical model generates quantitative predictions coincident in high (...) grade with observations without physical meaning. Philosophy intervened: in Substantivalism, spacetime exists in itself while in Relationalism as metrical relations. But, it does not know what spacetime. The outcomes of model have supported during a century, validity of the General Relativity, interpreted arbitrarily. Einstein formulated, from quadrupoles of energy, the formation of ripples in spacetime propagating as gravitational waves abandoned, in 1938, when he said that they do not exist. LIGO announced the first detection of gravitational waves from a pair of merging black holes. They truly are waves of quantum vacuum. (shrink)

Che cosa distingue, concettualmente, l’esattore delle tasse che esiga da un uomo, a pena di sanzioni, una determinata somma di denaro, dal bandito che gli intimi, sotto la minaccia di un’arma, di consegnargli la medesima somma? È sul soddisfacimento del requisito della giustizia che si fonda, come sostenne Agostino, l’eterogeneità tra uno Stato e un’accolita di furfanti? «Se non è rispettata la giustizia, che cosa sono gli Stati, se non delle grandi bande di ladri? Perché le bande di briganti che (...) cosa sono, se non dei piccoli Stati?». Il volume ripercorre le risposte più autorevoli fornite nel XX secolo, entro un orizzonte postmetafisico, alla domanda agostiniana: prima dell’avvento del regime nazista, la tesi che un’associazione a delinquere sia indistinguibile da uno Stato è stata sostenuta da Benedetto Croce, Santi Romano e Hans Kelsen; dopo l’esperienza del nazismo e delle sue atrocità, perpetrate in nome dello Stato e della legge, le questioni relative alla natura del diritto e alla relazione tra morale e diritto hanno assunto – come ha osservato Robert Alexy – «l’urgenza di un problema scottante», e la domanda filosofica sulla validità della legge ingiusta è apparsa ineludibile non solo ai maggiori filosofi del diritto (Herbert L.H. Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. Higher‐order evidence can make an agent doubt the reliability of her reasoning. When this happens, it seems rational for the agent to adopt a cautious attitude towards her original conclusion, even in cases where the higher‐order evidence is misleading and the agent's original reasons were actually perfectly good. One may think that recoiling to a cautious attitude in the face of misleading self‐doubt involves a failure to properly respond to one's reasons. My aim is to show that this is not (...) so. My proposal is that (misleading) higher‐order evidence can undermine the agent's possession of her first‐order reasons, constituting what I call a dispossessing defeater. After acquiring the higher‐order evidence, the agent is no longer in a position to rely competently on the relevant first‐order considerations as reasons for her original conclusion, so that such reasons stop being available to her (even if they remain as strong as in the absence of the higher‐order evidence). In this work it is unequivocally established that the maximum speed c for this type of transmission is false, causing critical break with Relativity. This chapter analyses the implications of findings in epigenetics for the ascription of moral responsibility for children. It contrasts shared understandings of procreative responsibility and discusses its extension to include all (individual or collective) actors who influence a child’s gene expression. It also problematizes the focus on biology in this process, using the example of epigenetics as a crossover between social and biological factors that contribute to a child’s life. Epigenetics blurs the boundary between biology and the environment, and thus (...) allows an analysis of contributions to children’s lives that goes beyond classical dualistic categories such as genetic versus environmental or biological versus social. In this paper, I defend a non-mechanistic interpretation of Kant's philosophy of nature. My interpretation contradicts the robust tradition of reading Kant as a mechanist about nature – or as someone who endorses the view that we can know the internally purposive causality characteristic of organisms has no place in nature. By attending closely to Kant's remarks about the possibility of internal purposiveness in nature and to key premises from Kant's arguments in the Antinomy of Teleological Judgment, we shall see (...) that it is not only plausible, but preferable, to believe that internally purposive things (i.e., organisms) exist in nature. Making room for such a belief leaves Kant with a philosophy of nature that simultaneously aligns with and surpasses the philosophies of nature offered up by his Early Modern predecessors. (shrink)

Gravity is the foundation of the current physical paradigm. Due to that gravity is strongly linked to the curvature of space-time, we research that it lacks of a valid physical concept of space-time, nevertheless that from the science philosophy, via substantivalism, it has tried respond. We found that is due to that the gnoseological process applied from the general relativity, necessarily us leads to metaphysic because ontologically space-time is a metaphysical entity. Thus, we arrive to the super substantivalism that from (...) metaphysics gives an answer on space-time rigorously exact with the vision of Einstein on physics. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

What is love? Is it an uncontrollable emotion? Is it, instead, socially shaped, both an emotion and a social practice? Can the bonds of care and affection between humans and non-human animals be said to be on a par with parent-child relationships between humans? Do parents owe love to their children – and do mothers and fathers, respectively, owe it to different degrees? Do subversive weddings challenge normative ideals about love? What is the significance of love for the value of (...) close personal or family relationships? All these questions and more are discussed in the articles included in this special issue. The contributors draw from a variety of disciplines including philosophy, sociology, political science, religious studies, and history, as well as from empirical work that they have undertaken in Canada, Belgium, Portugal, or Romania. From these different perspectives and experiences, each contribution addresses important questions about love and its relation to sexuality, monogamy, friendship, the family, parenthood, or society in general. In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives. In 2015 the United Kingdom (UK) became the first nation to legalize egg and zygotic nuclear transfer procedures using mitochondrial replacement techniques (MRTs) to prevent the maternal transmission of serious mitochondrial DNA diseases to offspring. These techniques are a form of human germline genetic modification and can happen intentionally if female embryos are selected during the MRT clinical process, either through sperm selection or preimplantation genetic diagnosis (PGD). In the same year, an MRT was performed by a United States (U.S.)-based (...) physician team. This experiment involved a cross-border effort: the MRT procedure per se was carried out in the US, and the embryo transfer in Mexico. The authors examine the ethics of MRTs from the standpoint of genetic relatedness and gender implications, in places that lack adequate laws and regulation regarding assisted reproduction. Then, we briefly examine whether MRTs can be justified as a reproductive option in the US and Mexico, after reassessing their legalization in the UK. We contend that morally inadequate and ineffective regulations regarding egg donation, PGD, and germline genetic modifications jeopardize the ethical acceptability of the implementation of MRTs, suggesting that MRTs are currently difficult to justify in the US and Mexico. In addition to relevant regulation, the initiation and appropriate use of MRTs in a country require a child-centered follow-up policy and more evidence for its safety. (shrink)

En este artículo argumentamos que la naturaleza pública o privada de la educación tiene una incidencia directa en las instituciones que conforman la realidad social. Para sustentar lo anterior, en primer lugar discutimos cómo, según Searle, habitamos un mundo de instituciones gobernadas por reglas y poderes deónticos, ontológicamente irreductibles. Luego, postulamos que la intencionalidad colectiva requiere de la confianza para mantenerse, y esta aumenta cuando gobiernan reglas y poderes deónticos en circunstancias normales. Finalmente, planteamos que la educación pública es una (...) institución que, a diferencia de la privada, privilegia el espacio de lo común. Sócrates es un ejemplo de esto, al proponer una filosofía que no solo busca la verdad, sino que además privilegia el reconocimiento de la ley por sobre la satisfacción inmediata de deseos e inclinaciones personales. De todo esto se explica el círculo virtuoso: la educación pública, al ser inclusiva y beneficiar a todos, potencia las instituciones sociales que tutelan ese interés y, dentro de ellas, el servicio público. Gravity is the curvature of spacetime, the structural property of static gravitational field, a geometric field, in curved coordinates, according the functions guv, that express geometric relations between material events. We use, analitic and critic method of reread the general relativity, since the perspective of the history of the science and the philosophy of the science. Our goal is driver the debate on (...) gravity, to the arena of the quantum physics, but without the ballast of the general relativity. We find that through of relativist aether was attempted transform spacetime in a substantia without succes, the consequence was return to problematic geometric field. The philosophy of the science intervenes, and according the best philosophical theory of substantivalism, spacetime is a inmaterial, geometric substantia. Then, the metaphysics arrives to a full solution in the super-substantivalism theory, that affirms: matter arises from geometric spacetime. Thus, it explains consistently the symetric physical effects between spacetime and matter. Surely, this solution is a medieval speculation. Our conclusion is that since general relativity do not defined physically spacetime leads necessarily to philosophical definitions of relationism and substantivalism on spacetime that are unacceptable physically. While the philosophers of science discuss the General Relativity, the mathematical physicists do not question it. Therefore, there is a conflict. From the theoretical point view “the question of precisely what Einstein discovered remains unanswered, for we have no consensus over the exact nature of the theory 's foundations. Is this the theory that extends the relativity of motion from inertial motion to accelerated motion, as Einstein contended? Or is it just a theory that treats gravitation geometrically in the spacetime (...) setting?”. “The voices of dissent proclaim that Einstein was mistaken over the fundamental ideas of his own theory and that their basic principles are simply incompatible with this theory. Many newer texts make no mention of the principles Einstein listed as fundamental to his theory; they appear as neither axiom nor theorem. At best, they are recalled as ideas of purely historical importance in the theory's formation. The very name General Relativity is now routinely condemned as a misnomer and its use often zealously avoided in favour of, say , Einstein's theory of gravitation What has complicated an easy resolution of the debate are the alterations of Einstein's own position on the foundations of his theory”, (Norton, 1993). Of other hand from the mathematical point view the “General Relativity had been formulated as a messy set of partial differential equations in a single coordinate system. People were so pleased when they found a solution that they didn't care that it probably had no physical significance” (Hawking and Penrose, 1996). So, during a time, the declaration of quantum theorists:“I take the positivist viewpoint that a physical theory is just a mathematical model and that it is meaningless to ask whether it corresponds to reality. All that one can ask is that its predictions should be in agreement with observation.” (Hawking and Penrose, 1996)seemed to solve the problem, but recently achieved with the help of the tightly and collectively synchronized clocks in orbit frontally contradicts fundamental assumptions of the theory of Relativity. These observations are in disagree from predictions of the theory of Relativity. (Hatch, 2004a, 2004b, 2007). The mathematical model was developed first by Grossmann who presented it, in 1913, as the mathematical part of the Entwurf theory, still referred to a curved Minkowski spacetime. Einstein completed the mathematical model, in 1915, formulated for Riemann ́s spacetimes. In this paper, we present as of General Relativity currently remains only the mathematical model, darkened with the results of Hatch and, course, we conclude that a Einstein ́s gravity theory does not exist. En este ensayo el autor supera la contradicción teórica existente entre la Relatividad General que define el campo gravitacional como un aspecto geométrico del espaciotiempo, bien como potencial o curvatura, y la Gravedad Cuántica que lo define como una fuerza de interacción fundamental, con el cambio de la concepción del espaciotiempo de propiedad geométrica estructural del campo gravitacional, a la concepción del espaciotiempo propiedad geométrica estructural de la materia en movimiento. El espaciotiempo no es continente de la materia (Substancialismo) sino (...) que por el contrario está contenido en la materia en cuanto constituye la estructura geométrica que le da su forma y permite sus cambios, a la cual como espacio le confiere su capacidad de contener y como tiempo su capacidad de devenir. Tampoco, el espaciotiempo es la categoría de las relaciones geométricas de los cuerpos materiales y sus eventos (Relacionismo), puesto que, no es una propiedad relacional de la materia sino la propiedad estructural espacio-temporal geométrica de la materia, a la cual la dota con sus capacidades de auto contenerse y transformarse. La teoría del autor sobre el espaciotiempo es la de la materia intrínsecamente dinámica, dotada estructuralmente de las cuatro dimensiones de espaciotiempo, autocontenida espacialmente y auto deviniendo temporalmente, puesto, que la materia en su capacidad de contener dinámicamente ésta ensimisma contenida y transformándose. La partícula-onda, de la materia y del campo, no existe en el espaciotiempo, sino que éste es la propiedad geométrica intrínseca estructural de la partícula-onda, por lo tanto, adherida a su propia naturaleza interna, como su propiedad geométrica dimensional intrínseca, que con fuerza de ley se manifiesta en sus mediciones cuantitativas, bien cuando es tomada la partícula-onda en sí o en relación con otras. Así, sólo son posibles las teorías sobre la gravedad provenientes de la Gravedad Cuántica, aunque, deben reformularse renunciando a integrarlas con la visión geométrica derivada de las ecuaciones de la llamada “General Relatividad”. The General Relativity understands gravity like inertial movement of the free fall of the bodies in curved spacetime of Lorentz. The law of inertia of Newton would be particular case of the inertial movement of the bodies in the spacetime flat of Euclid. But, in the step, of the particular to the general, breaks the law of inertia of Galilei since recovers the rectilinear uniform movement but not the repose state, unless the bodies have undergone their union, although, the curved (...) spacetime becomes flat and the curved geodesies becomes straight lines. For General Relativity is a natural law, within of a gravitational field, the uniform accelerated movement of the bodies, that leads to that a geometric curvature puts out to the bodies of the repose state for animate them of the movement of free fallen. In this paper this error of General Relativity, like generalization of the law of inertia of Galilei, is examined and it is found that it is caused by suppression of mass and force that allows conceiving acceleration like property of spacetime. This is a mathematical and non-ontological result. Indeed, mass and force are the fundament that the gravitational acceleration is a constant value for all the bodies, independently of the magnitude of mass but not of the mass and the gravitational force. The action of the gravity force, on inertial and gravitational masses of a body, produces mutual cancellation during its free fallen. In addition, by means of the third law of Newton it demonstrates that gravity is a force since weight is caused by gravity force. (shrink)

When a theory, as the general relativity, linked to special relativity, is foundation of a scientific paradigm, through normal science and academy, scientifics, professionals, professors, students and journals of that scientific community, the paradigm, it self-sustains and reproduces. Thus, the research is obligated and limited to apply the model existent of the paradigm to formulate problems and solve them, without searching new discoveries. This self-protection of the paradigm causes it to end its cycle of life, only after a long time, (...) until that arise unresolved anomalies, some presents since origin, that they finally cause its change by other new paradigm. In this work, we study the most important anomalies that are part of the foundations of general relativity with the goal of promoting the call period of transition that is previous to scientific revolution. We use critical analysis method for rereading the general relativity, from the perspective of the history of science and philosophy of science. We find, the structural and complex anomaly of general relativity based on metaphysical spacetime that produces the metaphysics replaces physics. Also, two internal anomalies their direct consequences. These are: matter curves metaphysical spacetime, and metaphysical spacetime determines the geodesic motion of physical matter. We conclude that general relativity has no valid physical concept of spacetime, therefore of gravity. For these reasons, a new paradigm is needed. (shrink)
